1. Formation of
contract
A contract
is formed upon written confirmation or confirmation via e-mail, but
finally after delivery of the product. Orders are accepted via Fax,
E-Mail or the Onlineshop. The contract will be conluded with the
following company:

2. Offer
All offers in our
Onlineshop are non-binding and subject to change. Small deviations and
technical changes to the displayed and/or described product are
possible, as far as reasonable.
3. Prices and
payment methods
By placing the order,
the customer agrees with the prices shown in our Onlineshop. All
prices are end user prices in Euro and are including VAT. Post &
Packaging are charged separately.
The customer selects its
preferred payment method. Further costs (e.g. COD charge, transfer
charge) caused by the payment method will be charged additionally.
The customer shall have
the right to offset claims as long as these claims are legally valid
or are recognised by AviaScan.

The
method of delivery may be decided by AviaScan. If the customer selects
another method of delivery, he has to pay possible extra costs. CoD
only within Germany.
We are entitled for part delivery in a reasonable manner. Additional
shipping costs do not arise in this case. Delivery period for products
not on stock may be up to two weeks past confirmation of the order.
For an on-time delivery we are dependent on a timely supply by our
contractors. Should it impossible to perform the service, AviaScan may
withdraw from the contract and does not need to perform the agreed
service. In such a case, AviaScan shall undertake to inform the
customer without delay that it is unable to perform the service and
shall immediately reimburse the the customer for any charges already
paid by him. In such a case, the customer may not claim damages.
5. Revocation
5.1 Right of revocation or return
The customer has the right of revocation within 14 days without giving
reasons. The contract shall be revoked in writing(e.g. letter, Fax, E-Mail)
or by returning the product within 14 days of receipt of the product.
The period for exercising the right of revocation shall be deemed
complied with if the contract is revoked in writing or the product
returned in due time. The revocation (return) shall be sent to:

5.2 Consequences
In the event of an effective revocation, goods
received by both parties must be returned. If the customer cannot
return the received goods in whole or in part, or can only return them
in a damaged state, DFS may claim compensation. This shall not apply
if the goods supplied were damaged during examination, as also
possible in a shop.
Moreover, it shall be possible to avoid having to fulfil the
obligation to pay damages by refraining from taking possession of the
goods as an owner would, and by avoiding actions which would devalue
the goods.
Goods which can be sent by parcel post shall
be returned by parcel post. In the case of returning a delivery of
goods or part thereof, the customer shall bear the costs of the return
delivery. Return deliveries, whose shipping costs have not been paid,
will not be accepted. This shall not apply if the goods delivered were
not the goods ordered.
AviaScan shall reimburse the price paid; in the case of bank transfers
abroad, the remittance fee shall be deducted.
As regards the supply for use or the use of the goods as well as other
services, the value of said goods and services up until the point at
which the right of revocation is executed shall be paid for.
Return of CDs is not possible if the seal is broken or the
software was already activated
Return of the product shall be done in its original packing. If that's
not possible the customer shall ensure a packing which exludes the
damage of the goods.
Obvious damage (especially defects, shipment by mistake or deviations
in amount), damages by shipment or other defects are to be forwarded
immediately, latest within 14 days of receipt of the goods in writing
to AviaScan. (eMail is sufficient).
6. Warranty
AviaScan sahllprovide a two-year guarantee for defects. This period
commences with the date of the invoice. The warranty does not include
wear and tear by the usual use or quality defects of a CD-ROM.
7.
Reservation of proprietary rights
Until the purchase price has been paid in full, the supplied goods
shall remain the property of AviaScan, regardless of wether the period
for the right to return goods has expired.
8. Data
protection
AviaScan uses customer's data to an extent necessary solely for the orderly
process of your order. All data is handled according to the German
Data Protection Act and the law pertaining to the data protection of
teleservices. The customer shall be entitled for information,
correction, securing and deletion of his data free of charge. Please
contact
info@aviascan.de or send your
inquiry via mail or Fax. AviaScan shall be entitled to pass on these
data to third parties, provided it is necessary to do so to conduct
business (e.g. as far as need for the orderly shipping and the orderly
payment processing). In this case AviaScan uses the minimum amount of
data necessary.
9. Internet
links
This website refers to other websites via hyperlinks. AviaScan is not
responsible for the content of those websites that are linked to via
the AviaScan website.
10.
Miscellaneous
Customer rights of this contract are non-transferrable and shall be
governed by German law.
